Within Australia, Family Law covers the legal issues related to family relationships. This includes Marriage, Divorce, Property, and Parenting arrangements. Family Law matters are often dealt with by the the Federal Circuit and Family Court of Australia or where possible, kept outside between solicitors with the aim to prevent costly Court battles and lengthy stretches between Court dates.

Family Court Applications / Responses

The court process involves stages, this includes hearings, mediation, and if necessary, a trial.

Negotiating Parenting arrangements

Involves discussions between parents regarding child custody, living arrangements and other decision-making processes.

Recovery Orders

If someone is not complying with a parenting order, for example refusing to return a child, or has taken a child from your care, we can help you apply through the Federal Court of Federal Circuit Court for a recovery order under the correct circumstances.

Legally Assisted Family Dispute Resolutions

Encouraging a more cooperative approach, minimizing the need for court intervention. Including mediation and other ways to reach an agreement. This can reduce the amount of time that is taken in Court so that an agreement is reached in a timely manner.

Breaches of Orders

This involves not following the terms outlined in the order, if someone breaches a Family Court Order, it is considered a serious matter.

Consent Orders

To obtain Consent Orders, both parties must agree on the terms, and the agreement is then prepared in the correct forms and sent to the Family Court or Federal Circuit Court for approval.

Property Settlement

This involves the division of assets and liabilities between separating/separated or divorcing/divorced parties. A property settlement can be reached through negotiation, mediation, or even court orders if an agreement is unable to be reached.

Divorce matters

Is the legal process of ending a marriage. You must meet certain requirements when filing for divorce. This process is separate from arrangements related to children or property. You should only apply when there is an ‘irretrievable breakdown’ and you have been separated from the other party for at least 12 months with no likelihood of returning to that relationship.
